Backed by years of professional experience helping others with cases like yours, we know how hard it can be to recover from serious injuries caused by a bicycle accident, which is why we always make our clients our main priority.

How Common Are Bicycle Accidents in Utah?

Biking can be a great, eco-friendly mode of transportation, as well as an enjoyable pastime, but bicycle accidents are often devastating, especially when considering a bicyclist’s primary source of protection is only a helmet. It may be a vital safety precaution, but it is not going to protect a bicyclist against injury in a collision with an automobile, bus or truck. In fact, data from the National Highway Traffic Safety Administration (NHTSA) revealed that more than 800 bicyclists died as a result of traffic crashes in 2018 alone.

For this reason, there are efforts to mitigate bicycle crashes across the country — such as bicycle safety initiatives and the implementation of bicycle lanes in high-traffic areas — but accidents still occur quite frequently. If your injury could have been prevented by a driver giving the road their full attention, properly manufactured bicycle equipment or better city safety measures, then you may have grounds for a case.

Do I Have a Case?

If another party injured you because of any of the following forms of negligence, you may have a case:

  • Absence of a bike lane
  • Defective bicycle equipment
  • Defective helmet
  • Distracted driving
  • Reckless driving
  • Driving under the influence

Utah’s Bicycle Laws

In order to ensure the best standard of safety possible for bicyclists, the state of Utah requires bicyclists, drivers and cities to adhere to certain laws. This includes the law colloquially known as the “3-Foot Law,” which prohibits motorists from passing within 3 feet of bicyclists on the road and forcing them off the road. Likewise, drivers are not allowed to purposely emit excessive exhaust from their vehicles to endanger or harass a bicyclist.

Most importantly, bicyclists must follow the rules of the road, as bicycles are considered vehicles. Therefore, bicyclists are prohibited from texting while riding. They are required to obey traffic signals and must yield the right of way to pedestrians. Just as a motor vehicle requires regular maintenance, bicycles must also be kept in proper condition.

Adhering to the laws of the road is not only best for your safety, but if you are involved in an accident and were in violation of one of these laws, your case will be significantly weakened. The court and jury will take any violations on your part into account, no matter if the accident was caused by a negligent party in violation of a more serious law.

What Affects Compensation?

Besides adherence to bicycle laws, the severity of your injuries and their associated expenses will affect the outcome of your bicycle accident claim. Injuries include broken bones, spinal cord injuries, lacerations, dental fractures, road rash and more.

If you are the victim of a bicycle accident, it is advisable to do the following as soon as possible:

  • Contact the police as soon as the accident occurs
  • See a medical professional to address your injuries
  • Do not admit fault, regardless of how intimidating the other party seems
  • Discuss your case with a skilled attorney

A strong case can result in compensation to cover damages for medical bills or other financial expenses caused by the accident. Compensation may also cover pain and suffering, emotional distress, disability or a reduced quality of life, if appropriate.
